Terms & Conditions of Use for Chronic Condition Care for You, Inc, Products

By accessing and using this Product, you agree to be bound by these Terms of Use. For certain Products offered by Chronic Condition Care for You, your explicit agreement to these Terms may be required before the Product is made available to you. In such cases, you must affirmatively indicate your acceptance by checking a box or using another method of acceptance provided. Chronic Condition Care for You’s Privacy Policy is incorporated into and forms an integral part of these Terms. The current Chronic Condition Care for You Privacy Policy may be found in the Privacy Policy section of this site. If you do not agree to these Terms, do not indicate your acceptance or use the Product. If at any time you wish to withdraw your acceptance of these Terms, you must immediately discontinue your use of the Product.

1. Definitions.

  • “Client User” means an entity that has the Product license or has licensed the Product directly from Chronic Condition Care for You or has sublicensed it through an authorized Chronic Condition Care for You sublicensor, such as a healthcare provider organization.

  • “End User” means a consumer, patient, or other individual who receives access to the Product.

  • “Chronic Condition Care for You” means Chronic Condition Care for You Incorporated, located at 7659 Mall Rd., #1010, Florence, KY 41042.

  • “Product” means the Chronic Condition Care for You proprietary health education information and technology, along with any incorporated Third-Party Materials.

  • “Terms” means these Terms of Use for Chronic Condition Care for You Products, which may be modified from time to time as provided herein.

  • “Third-Party Materials” means certain works, materials, information, or technology included within the Product that are owned by a third party.

2. Applicability.

These Terms apply to you as an End User. If you have access to one or more Products, these Terms govern your use of all such Products. If any specific terms apply to a particular Product, those special terms will be provided with that Product and will govern to the extent they conflict with these general Terms.

3. Changes to These Terms.

Chronic Condition Care for You reserves the right to modify these Terms at any time. You agree that we may notify you of such changes by posting the updated Terms on this page, which is linked within the Product. Your continued use of the Product after the posting of any changes constitutes your acceptance of the revised Terms. All changes to these Terms will be effective as of the date they are posted. Therefore, please review these Terms periodically, not only before your initial use but also frequently thereafter.

Chronic Condition Care for You will notify Client Users of any material changes in accordance with their contractual agreements. Please be aware that free online tools are available for you, the End User, to monitor changes to websites. If you do not agree to these Terms, you must not use the Product.

4. Use of the Product.

The Product is provided for informational purposes only and is intended solely to support Chronic Condition Care for You’s mission of providing End Users with health-related information and resources. The Product is not a substitute for professional medical advice, diagnosis, or treatment. It is not intended for, nor should it be used as a substitute for, the rendering of medical, nursing, or professional healthcare advice or services, or the practice of medicine in any jurisdiction. Always seek the advice of your licensed primary healthcare provider or other qualified healthcare provider for any questions you may have regarding a medical condition or before making any decisions related to your health or treatment.

Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through the Product. If you think you may have a medical emergency, call your doctor or 911 immediately. Chronic Condition Care for You does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned or included in the Product. Images and videos within the Product are for illustrative purposes only and may not be representative of your specific situation.

Medical research is constantly evolving, and developments may impact the information presented in the Product. While Chronic Condition Care for You and its suppliers and vendors strive to keep the resources contained within or accessible through the Product current and accurate, we make no guarantees regarding the accuracy, reliability, relevance, timeliness, completeness, or appropriateness of the information for any particular purpose, and any implied warranties or representations in this regard are hereby disclaimed. Your use of the Product is also subject to any additional disclaimers and caveats that may appear throughout the Product.

These Terms and your right to access and use the Product will automatically terminate if you fail to comply with any of these Terms. Such termination will not limit any other rights or remedies available to Chronic Condition Care for You. However, any provision of these Terms that, by its nature, should survive termination to give proper effect to its intent and purpose will continue in full force and effect after termination.

5. Privacy and Security.

You hereby consent to the collection, use, and disclosure of personally identifiable information and other data obtained from you in connection with your use of the Product (“Service Data”) in accordance with the Privacy Policy. You further agree that Chronic Condition Care for You and its suppliers have the right to collect, extract, compile, synthesize, and analyze Service Data as described in the Privacy Policy. Service Data may also be shared with the Client User who provided you with access to the Product. You hereby grant to Chronic Condition Care for You a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to modify and adapt any Service Data so that it is anonymized and not personally identifiable. You further grant Chronic Condition Care for You, without charge, the right to use, copy, display, transmit, excerpt, publish, distribute, and create derivative works from such anonymized Service Data for any lawful purposes, including improving the operation, functionality, or use of Chronic Condition Care for You’s existing and future product offerings.

6. End User’s Responsibilities.

You represent and warrant that you are of the age of legal majority (generally 18 years of age or older) in your place of residence and possess the legal right and ability to agree to these Terms and to use the Product in accordance with these Terms. If you are not of the age of legal majority, you agree to use the Product only under the direct supervision of a parent or legal guardian who is of legal majority age. You agree to ensure that anyone you authorize to access the Product complies with these Terms.

Depending on the specific Product, you may be required to log in or register for a personal account. You are responsible for maintaining the confidentiality and security of your log-in information and any other personal information related to your use of your account. You agree to provide accurate, current, and complete information about yourself during any registration process and to maintain and promptly update such information to keep it accurate, current, and complete.

You agree that you will not use the Product to transmit any communications or content of any type that infringe or violate the rights of any other person or entity, including but not limited to intellectual property rights, privacy rights, or contractual rights.

You agree that you will not use the Product for any purpose that is unlawful or prohibited by these Terms or any applicable local, state, national, or international laws, rules, or treaties. You are solely responsible for ensuring your compliance with all laws applicable to your use of the Product based on your location.

7. Intellectual Property Rights.

You are not permitted, and you agree not to allow any third party, to sell, lease, modify, reproduce, reverse engineer, decompile, disassemble, transcribe, store in a retrieval system, translate into any language or computer language, retransmit in any form or by any means (electronic, mechanical, photocopying, recording, or otherwise), sublicense, resell, or redistribute the Product or any part thereof without the express prior written consent of Chronic Condition Care for You. Furthermore, you are strictly prohibited from publicly performing or displaying, distributing, creating derivative works based on, or otherwise exploiting the Products or any part thereof for any public or commercial purpose, or from making the Product or any part thereof publicly available or accessible to any unauthorized person. You are not permitted to use any trademark, service mark, or other proprietary marks of Chronic Condition Care for You without obtaining prior written consent.

If you wish to use our health information materials in any manner not expressly permitted under these Terms, please visit our Contact Us  to request permission. Please note that extracting any images or other materials from the Product for your personal use on your blog or website is prohibited without explicit written permission from Chronic Condition Care for You.

8. Disclaimer of Warranties.

Your use of the Product is at your sole risk. The Product is provided on an “AS IS” and “AS AVAILABLE” basis only. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHRONIC CONDITION CARE FOR YOU AND ITS SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. Without limiting the foregoing, Chronic Condition Care for You and its suppliers make no representations or warranties (written or oral) regarding the accuracy, reliability, completeness, security, or timeliness of the Product or any content therein.

9. Limitation of Liability.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT CHRONIC CONDITION CARE FOR YOU AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR PERSONAL INJURY/WRONGFUL DEATH), ARISING OUT OF OR RELATING TO YOUR USE OF THE PRODUCT OR YOUR INABILITY TO USE THE PRODUCT, EVEN IF CHRONIC CONDITION CARE FOR YOU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE PRODUCT IS TO STOP USING THE PRODUCT.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF CHRONIC CONDITION CARE FOR YOU AND ITS SUPPLIERS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF, MISUSE OF, OR INABILITY TO USE THE PRODUCT SHALL BE LIMITED TO THE AMOUNT OF ACTUAL DIRECT DAMAGES INCURRED BY YOU, NOT TO EXCEED ONE THOUSAND U.S. DOLLARS ($1000.00).

In no event shall Chronic Condition Care for You or its suppliers be liable for any loss or damage that is not reasonably foreseeable.

10. Indemnification.

You agree to defend, indemnify, and hold harmless Chronic Condition Care for You, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, actions, demands, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your (or anyone using your account’s) violation of these Terms or your use or misuse of the Product.

11. Miscellaneous.

You expressly agree that any legal dispute, action, or proceeding arising out of or relating to your use of the Product or these Terms shall be exclusively subject to the jurisdiction of the state courts located in the State of Kentucky, and you irrevocably consent to the personal jurisdiction of such courts. These Terms shall be governed by and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of laws principles. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. No waiver by Chronic Condition Care for You of any provision of these Terms shall be deemed a further or continuing waiver of such provision or a waiver of any other provision, and Chronic Condition Care for You’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
